کمیسیون امور عدلی و قضایی مجلس نمایندگان افغانستان خواستار حضور نیرومند‌تر نهادهای جامعه مدنی در تعیین اعضای کمیسیون انتخابات شده است.

این کمیسیون می گوید، طرح مشخصی را در مشورت با نهادهای مدنی و بنیاد انتخابات آزاد و عادلانه (FEFA) تهیه کرده است که اجرای آن، به برگزاری انتخابات شفاف کمک خواهد کرد.

بحث نحوه انتخاب و تعیین اعضای کمیسیون مستقل انتخابات افغانستان، پس از آن بالا گرفت که حکومت، پیش نویس قانون ساختار و اختیارات این کمیسون را به مجلس نمایندگان فرستاد.

پیشنهادهای کمیسیون قضایی

براساس پیش نویسی که حکومت افغانستان به پارلمان فرستاده، اعضای کمیسیون مستقل انتخابات هفت نفر پیش بینی شده که از سوی رئیس جمهوری منصوب می شوند.

این پیش نویس همچنین مدت کار اعضای این کمیسیون را سه سال پیش بینی کرده است.

اما در پشنهادات کمیسیون عدلی و قضایی مجلس نمایندگان آمده است که اعضای کمیسیون مستقل انتخابات باید یازده نفر باشند و این اعضا در مشورت با نهادهای جامعه مدنی برگزیده شوند.

براساس این پیشنهاد، یک شورای گزینش با شرکت روسای هر دو مجلس شورای ملی ( مجلس نمایندگان و سنا) روسای دادگاه عالی، کمیسیون نظارت بر تطبیق قانون اساسی، کمیسیون حقوق بشر و احزاب سیاسی که حداقل یک درصد در پارلمان عضو داشته باشند، تشکیل شده و صلاحیت نامزدهای کمیسیون مستقل انتخابات از سوی این شورا ارزیابی شود.

کمیسیون عدلی و قضایی مجلس نمایندگان پیشنهاد کرده است که این شورا، شانزده نفر را به رئیس جمهوری پیشنهاد کند و رئیس جمهور از این میان یازده نفر را برای عضویت در کمیسیون مستقل انتخابات منصوب کند.

همچنین پیشنهاد شده است که مدت کاری اعضای کمیسیون انتخابات، به جای سه سال، شش سال باشد.

شیوه گزینش و انتصاب اعضای کمیسیون انتخابات افغانستان، در گذشته با انتقاد بسیاری از سوی شماری از گروه های سیاسی افغانستان روبرو بوده است.

این گروه ها، در مواردی، رئیس جمهوری را به اعمال نفوذ در روند انتخابات از طریق تعیین افراد مورد نظر خود در کمیسیون مستقل انتخابات، متهم کرده اند.
